First, I would like to welcome people back to he blog. Getting The Gay Marriage Alternative out took its toll on me, and I needed to step back and concentrate on the law firm for a bit. But now I am back on schedule, and what a topic to come back to.
While gay marriage is always the hot LGBT topic in the mainstream media, another kind of legislation that should be a slam dunk is anti-bullying legislation. People can have religious differences on gay marriage, but people who truly respect the Constitution can see that the same rights have to be for everyone under the law regardless of what religious doctrine states. But when it comes to people being bullied because they are gay, there is no legitimate difference of opinion. But apparently the Catholic Bishops of Raleigh and Charlotte have found a reason to oppose such legislation in North Carolina.
Msgr. Michael Clay, the legislative lobbyist for the Diocese of Raleigh, said three states--Iowa, California and Connecticut--have used similar anti-gay bullying laws as part of their "findings of fact," in building a case for same-sex marriage. "It could be a precursor by our legislature and/or our courts to mandate same-sex marriage," said Clay. "It's more than speculative. This is a result that happens." (From the News and Observer).
Msgr. Clay is actually right, but the bigger questions is how is he right? Courts typically list a myriad of facts to support an opinion, but they may be as mundane as "16% of the population of Someplace, Somestate is Hispanic," or "there are more than 100 noise complaint calls per night lodged with the city police." Stating that there is an anti-bullying law in the findings of fact does not lead to gay marriage, but what it does do is acknowledge that there is prejudice against gays which lead to the legislature protecting gay teens from being beat up and harrassed in school.
That is how Msgr. Clay is right about the findings of fact. But apparently, and unfortunately as it has been with the Catholic Church in the past, acknowledging these kinds of facts becomes inconvenient because it means that the rabid anti-gay donors and churchgoers may stop supporting the Catholic Church if it doesn't go along with the hatred. If Msgr. Clay is an attorney, then he is really, really reaching in his legal logic to justify going against a bill that stops gay teens from being beaten up in school. If he were arguing this case in front of a judge, it is likely he would be laughed at in open court. But it is the only thing he can hang his hat on to justify opposing this bill that anyone other than vicious anti-gay people might believe--that anti-bullying legislation will somehow lead to gay marriage. And once again, an organized religion is putting hatred and the money it brings ahead of the well-being of people unfairly targeted, abused and assaulted. How much money is a gay teen's life and well-being worth, anyway?
